Associate Laura Wibberley addresses the applicability of immunity from civil liability amidst the continuing challenges of staffing shortages, insufficient supplies and delayed vaccine administration in her case law update titled “The PREP Act Update: The Prevailing COVID-19 Immunities.”

While healthcare facilities and providers continue to face daily challenges as the pandemic continues to wear on, the issues surrounding civil liability have caused the Secretary of Health and Human Services to revisit and expand the applicable immunities under the PREP Act. New declarations have continued to increase the scope of liability protections given the unprecedented realities of the pandemic, providing optimism that immunities will continue to expand as the pandemic continues.
