Not guilty after Removal of Skin Cancer

Circuit Court of Cook County, Illinois
Counsel: Anne Kuban & Anne Phillips
Demand: $150,000-$300,000
Asked: Same
Outcome: Not Guilty

Plaintiff presented to defendant dermatologist in September 2010 for a lesion on his nose. A biopsy confirmed basal cell carcinoma and an excision was scheduled. The excision was performed without complication. Plaintiff returned to the defendant dermatologist 2 days later due to concerns about wound healing. A topical ointment was given but infection and/or wound compromise was ruled out. Plaintiff’s stitches were removed 14 days later. Plaintiff has remained cancer free but claimed that the doctor was negligent because he has a scar on his nose where the cancer was removed.
